Terms of Service

These terms govern your use of the GIME website and any membership account you create on it. By using the site or creating an account, you agree to them. If you do not agree, please do not use the site.

Membership

Your account

  • You must be at least 18, or have the consent of a parent or guardian.
  • The details you give us must be accurate, and you must keep them up to date.
  • You are responsible for keeping your password confidential and for everything done through your account. Tell us immediately if you think someone else has access to it.
  • You may close your account at any time by contacting us.

Ground rules

Acceptable use

You agree not to:

  • break any applicable law, or infringe anyone's rights;
  • upload or send anything unlawful, defamatory, harassing, hateful or deliberately misleading;
  • attempt to gain unauthorised access to the platform, other accounts, or the systems behind them;
  • disrupt the service, including by scraping at a scale that degrades it, or by circumventing rate limits or security measures;
  • impersonate anyone, or misrepresent your association with any person or organisation.

We may suspend or close an account that breaches these rules.

Ownership

Content and intellectual property

The GIME name, logo, site design, text, images, audio and video are owned by GIME or used with permission, and are protected by copyright and trade mark law. You may read and share our public pages, but you may not copy, republish or adapt our content commercially without written permission.

Anything you submit to us — an enquiry, a message, material sent for a project — remains yours. By submitting it you give us permission to use it for the purpose you sent it for. Do not send us material you do not have the right to share.

Where we produce work for a client, ownership of that work is governed by the separate written agreement for that engagement, not by these terms.

Commercial work

Services, quotes and payments

The service descriptions on this site are an introduction to what we do, not a binding offer. Production, training, civic education and brand work are each agreed in a separate written contract that sets out scope, deliverables, timelines and fees. Where that contract and these terms conflict, that contract wins.

Creating an account on this site is free. We will always tell you the price and the terms before you pay for anything.

Third parties

Other platforms and links

This site links to Ufasaha wa Lugha (Learn 2 Learn) at ufasahawalugha.co.ke and to other third-party sites. Ufasaha is operated under the GIME group but has its own accounts, its own terms and its own privacy policy — those apply when you use it.

We are not responsible for the content or practices of any third-party site we link to.

Limits

Availability and liability

We work to keep the site available and accurate, but we provide it "as is". We do not promise it will be uninterrupted, error-free, or that the content is complete or current at every moment. We may change, suspend or withdraw any part of it.

To the fullest extent the law allows, GIME is not liable for indirect or consequential loss, loss of profit, loss of business, or loss of data arising from your use of this site. Nothing in these terms limits liability for death or personal injury caused by negligence, for fraud, or for anything else that cannot lawfully be limited.

The fine print

Changes and governing law

We may update these terms. The date at the top of this page shows when they last changed, and we will notify account holders of significant changes. Continuing to use the site after a change means you accept the updated terms.

These terms are governed by the laws of Kenya, and the courts of Kenya have jurisdiction over any dispute arising from them.
